National Medical Insurance Bureau: the cost of three children’s childbirth is included in the payment of maternity insurance

In order to actively support the implementation of the three child policy, the State Medical Security Bureau recently issued the notice on doing a good job in supporting the three child policy maternity insurance (hereinafter referred to as the notice), requiring all localities to include the expenses of the insured female employees for giving birth to three children into the payment scope of maternity insurance benefits, and pay maternity medical expenses and maternity allowances in time and in full according to the regulations.

The notice clearly stipulates that we should ensure the treatment of reproductive medical expenses of urban and rural residents and the insurance of newborns at the same time.

The reporter of “daily economic news” noted that in order to implement the policy of supporting childbirth, local governments began to take action. On July 28, Panzhihua City, Sichuan Province held a press conference to announce and interpret in detail the “16 policies and measures on promoting human resources aggregation”. Among them, Panzhihua registered residence with two or three children by policy, 500 yuan per child per month, until child 3 years old, is the first and only child care subsidy city in the country.

Insured female workers will reduce the burden

Maternity insurance is a social insurance system in which the state and society provide timely life security and material assistance when professional women temporarily interrupt their work due to childbirth.

China’s maternity insurance benefits mainly include two items: Maternity medical treatment (including the examination fee, delivery fee, operation fee, hospitalization fee and medicine fee of female employees) and maternity allowance (the maternity allowance during the maternity leave enjoyed by female employees according to law shall be calculated and paid according to the average monthly salary of employees of the enterprise in the previous year).

Fertility insurance is not subject to registered residence restrictions. If the people who take part in maternity insurance are given birth in other places, their related treatment will be implemented according to the policy standards of the insured areas.

Li Zhen, a professor at the school of public administration of Renmin University of China, told reporters that maternity insurance provides protection for medical expenses and maternity allowance during maternity leave. When maternity insurance was established in 1994, the insured who gave birth to an only child could enjoy maternity benefits; When the two child policy is fully liberalized, the system is extended to the insured who have two children. Now, in the context of the three child policy, the benefit is extended to the insured who have three children, which is good for the insured who intend to have three children.

According to the special provisions on labor protection for female employees, female employees enjoy 98 days of maternity leave during childbirth, including 15 days of prenatal leave; In case of dystocia, the maternity leave shall be increased by 15 days; For multiple births, the maternity leave will be increased by 15 days for each additional baby.

The maternity allowance for female employees during maternity leave shall be paid by the maternity insurance fund according to the standard of the average monthly salary of employees of the employing unit in the previous year for those who have participated in maternity insurance; If the employer fails to take maternity leave, the wage shall be paid by the female employee according to the standard before maternity leave.

According to the website of the National Bureau of statistics, in 2020, the average annual wage of employees in Urban Non private units was 97379 yuan, and the average annual wage of employees in urban private units was 57727 yuan.

According to the above-mentioned policies related to China’s maternity allowance, Li Zhen estimated that the medical expenses and maternity allowance for giving birth to a child can reach tens of thousands of yuan, which can greatly alleviate the worries of female workers from economically disadvantaged families.

Create more employment opportunities for women

At present, some female employees are worried about whether they will be dismissed by the company or not enjoy maternity allowance due to the birth of three children before the formal introduction of relevant three child laws, regulations and policies.

Lawyer Liang Hui of Beijing Daocheng law firm told the daily economic news that the labor law and labor contract law have made provisions to protect the labor rights and interests of female employees. For the situation of female workers having three children, it has never been clear in judicial practice that employers can terminate labor relations accordingly. For example, according to the provisions of the law on the protection of women’s rights and interests, no unit may reduce the wages of female employees, dismiss female employees, and unilaterally terminate labor (employment) contracts or service agreements due to marriage, pregnancy, maternity leave, breastfeeding and other circumstances.

Therefore, if an employer dismisses a female employee because she has three children, it is an illegal dismissal. The female employee can apply to the local labor dispute arbitration committee for arbitration and protect her rights according to law. After the introduction of the policy of the National Medical Insurance Bureau, female employees who have three children should enjoy normal maternity treatment, including maternity leave, maternity allowance and medical services.

“Maternity insurance is the state’s special welfare for female workers during pregnancy and childbirth. Maternity insurance not only provides stable income and medical security for female workers during pregnancy and childbirth, but also creates more equal employment opportunities for women in the workplace! Of course, the most intuitive benefit of maternity insurance is that you can receive a large allowance for having three children.” Liang Hui said.

Liang Hui stressed that maternity insurance provides maternity allowances, maternity leave and medical services to insured female workers to ensure their basic economic income and medical care when they temporarily lose their ability to work due to childbirth, and help female workers restore their ability to work and return to work.

Chang Zhifeng, senior partner of Beijing Lianggao law firm, said that because the policy has just been introduced, all localities are also stepping up the formulation of relevant detailed rules in accordance with the regulations. It is estimated that the detailed rules will be published soon.
