All naming systems have a problem with squatting on brand names. The traditional DNS system solves this with arbitration systems through the traditional legal system. At ENS we don’t have this kind of system currently in place, because a key weakness of an arbitration system is that the system itself needs power to take over a name. If any system has the power to take over the name, it reduces the sovereignty of a name, a quality that is a top priority for a naming system. For ENS this would also begin to infringe on the first amendment of the ENS constitution:
